DISTANCE SALES CONTRACT
1. ARTICLE 1 – SUBJECT:
The subject of this contract is {INVOICE ADDRESS} resident at {INVOICE ADDRESS} (hereinafter referred to as "BUYER" in the contract) and Giovanni Fratelli-Profsin Communication Technologies Inc. resident at BALABANAĞA MAH. HARIKZEDELER SK. NO: 11 INC. DOOR NO: 202 Fatih / İstanbul (hereinafter referred to as "SELLER" in the contract), regarding the sale and delivery of the product whose characteristics and sales price are specified below, in accordance with the provisions of the Regulation on the Application Principles and Procedures of Distance Contracts Law No. 4077 on the Protection of Consumers.

ARTICLE 5- GENERAL PROVISIONS
5.1 - BUYER- declares that he/she has read and is informed about the basic characteristics, sales price and payment method of the contracted product specified in Article 4 and all preliminary information regarding delivery and has given the necessary confirmation electronically.
5.2 - The contracted product shall be delivered to the person/organization at the address specified by the BUYER - within the period specified in the preliminary information or depending on the distance of the BUYER's place of residence, provided that it does not exceed the legal 30-day period for each product.
5.3 - If the product subject to the contract is to be delivered to a person/organization other than - BUYER -, Giovanni Fratelli - Profsin İletişim Teknolojileri AŞ. cannot be held responsible if the person/organization to whom the delivery is made does not accept the delivery.
5.4 - Giovanni Fratelli - Profsin İletişim Teknolojileri AŞ. is responsible for the delivery of the product subject to the contract in a sound, complete manner, in accordance with the specifications specified in the order and with the warranty documents and user manuals, if any.
5.5 - For the delivery of the product subject to the contract, it is required that the signed copy of this contract is delivered to - BUYER - and the price is paid with the payment method preferred by - BUYER -. If the product price is not paid or is canceled in the bank records for any reason, Giovanni Fratelli - Profsin İletişim Teknolojileri AŞ. is deemed to have been released from the obligation to deliver the product.
5.6 - If the relevant bank or financial institution does not pay the product price to Giovanni Fratelli-Profsin İletişim Teknolojileri AŞ. due to the unfair or illegal use of the credit card belonging to the BUYER by unauthorized persons for reasons not caused by the fault of Giovanni Fratelli-Profsin İletişim Teknolojileri AŞ. after the delivery of the product, the product must be sent to Giovanni Fratelli-Profsin İletişim Teknolojileri AŞ. within 3 days, provided that it has been delivered to the BUYER. In this case, the shipping costs belong to the BUYER.
5.7- If Giovanni Fratelli-Profsin İletişim Teknolojileri AŞ. cannot deliver the product subject to the contract within the due date due to force majeure or extraordinary circumstances such as adverse weather conditions or interruption of transportation, it is obliged to notify the BUYER of the situation. In this case, -BUYER- may exercise one of the following rights: cancellation of the order, replacement of the contractual product with a similar one, if any, and/or postponement of the delivery period until the impeding situation is eliminated. If -BUYER- cancels the order, the amount paid shall be paid to him/her in cash and in a lump sum within 10 days.
5.8 - Defective or broken products sold with or without a warranty certificate may be sent to Giovanni Fratelli-Profsin İletişim Teknolojileri AŞ. for the necessary repair under warranty conditions, in which case the cargo costs will be covered by Giovanni Fratelli-Profsin İletişim Teknolojileri AŞ.
5.9 - This contract shall become valid after it is signed by -BUYER- and delivered to Giovanni Fratelli - Profsin İletişim Teknolojileri AŞ.

Invoice Delivery: The invoice will be delivered to the delivery address together with the order during the delivery of the order.
ARTICLE 7 - RIGHT OF WITHDRAWAL
The BUYER has the right of withdrawal within (14) days from the delivery of the product subject to the contract to him/her or to the person/institution at the address he/she has indicated. In order to exercise the right of withdrawal, it is required that Giovanni Fratelli-Profsin İletişim Teknolojileri AŞ. is notified by e-mail or telephone within this period and that the product has not been used within the framework of the provisions of Article 7. In case of exercise of this right, it is mandatory to return the cargo delivery report copy stating that the product delivered to the 3rd person or -BUYER- was sent to -BUYER- and the original invoice. The product price is returned to -BUYER- within 7 days following the receipt of these documents. If the original invoice is not sent, VAT and other legal obligations, if any, cannot be returned. The cargo cost of the product returned due to the right of withdrawal is covered by -BUYER-.
ARTICLE 8 - PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED
The right of withdrawal cannot be used for products that cannot be returned due to their nature, single-use products, copyable software and programs, products that deteriorate quickly or whose expiration date has passed.
The use of the right of withdrawal in the following products is subject to the condition that the packaging of the product is unopened, intact and the product has not been used.

ARTICLE 9 - AUTHORIZED COURT
In the implementation of this contract, Consumer Arbitration Committees up to the value declared by the Ministry of Industry and Trade and Fatih Consumer Courts at the location of Giovanni Fratelli - Profsin İletişim Teknolojileri AŞ. are authorized.
In the event of the order being placed, the BUYER is deemed to have accepted all the terms of this contract.
